the State Government for other establishments.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Workman:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0Any person employed in or in connection with the work of an establishment to do any skilled, semi-skilled, or unskilled manual, supervisory, technical, or clerical work, excluding managerial or administrative staff and out-workers.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Contract Labour:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0A workman deemed to be employed in connection with the work of an establishment when hired by or through a contractor.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Contractor:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0A person who undertakes to produce a given result for the establishment through contract labor or who supplies contract labor for any work of the establishment, including a sub-contractor.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Controlled Industry:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0An industry under the control of the Union, as declared by a Central Act.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Establishment:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0Any office, department of the government, local authority, or any place where an industry, trade, business, manufacture, or occupation is carried on.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Principal Employer:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0The head of a government office or department, the owner or occupier of a factory or mine, or any person responsible for the supervision and control of an establishment.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Wages:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0As defined in the Payment of Wages Act, 1936.<\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"ng-star-inserted\" style=\"text-align: justify;\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Applicability of the Act (Section 1(4)):<\/span><\/strong><\/p>\n<ul class=\"ng-star-inserted\" style=\"text-align: justify;\">\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">The Act applies to every establishment in which 20 or more workmen are employed or were employed on any day of the preceding 12 months as contract labor.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">It also applies to every contractor who employs or employed 20 or more workmen on any day of the preceding 12 months.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">The appropriate government can extend the Act to establishments or contractors employing fewer than 20 workmen by notification.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">The Act does not apply to work of an intermittent or casual nature. Work is not considered intermittent if it is for more than 120 days in the preceding 12 months or if it is seasonal and is performed for more than 60 days a year.<\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"ng-star-inserted\" style=\"text-align: justify;\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">State-Specific Amendments to Applicability:<\/span><\/strong><\/p>\n<ul class=\"ng-star-inserted\" style=\"text-align: justify;\">\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Maharashtra:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0The Act applies to establishments and contractors employing 50 or more workmen.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Andhra Pradesh:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0The Act applies to establishments and contractors employing 50 or more workmen.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Uttar Pradesh:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0The Act applies to establishments and contractors employing 50 or more workmen.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Jammu and Kashmir and Ladakh:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0The Act applies to establishments and contractors employing 40 or more workmen.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Rajasthan:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0The Act applies to establishments and contractors employing 50 or more workmen.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Gujarat:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0The Act applies to establishments and contractors employing 50 or more workmen.<\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"ng-star-inserted\" style=\"text-align: justify;\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Advisory Boards (Sections 3, 4, and 5):<\/span><\/strong><\/p>\n<ul class=\"ng-star-inserted\" style=\"text-align: justify;\">\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">The Central Government constitutes a Central Advisory Board to advise on matters related to the administration of the Act.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">State Governments can constitute State Advisory Boards for similar purposes.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">These boards consist of representatives from the government, employers, employees, and other relevant interests.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">The boards can also constitute committees for specific purposes.<\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"ng-star-inserted\" style=\"text-align: justify;\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Registration of Establishments (Sections 6, 7, 8, and 9):<\/span><\/strong><\/p>\n<ul class=\"ng-star-inserted\" style=\"text-align: justify;\">\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Every principal employer must register their establishment with the registering officer.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">The registration certificate includes details of the establishment and the nature of work.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Registration can be revoked if obtained by misrepresentation or if it becomes justify;\">\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Contractors must obtain a license from the licensing officer before undertaking any work amended for non-compliance or misrepresentation.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Appeals against orders related to licensing can be made to an appellate officer.<\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"ng-star-inserted\" style=\"text-align: justify;\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Welfare and Health of Contract Labour (Sections 16, 17, 18, 19, and 20):<\/span><\/strong><\/p>\n<ul class=\"ng-star-inserted\" style=\"text-align: justify;\">\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Contractors must provide canteens, rest rooms, drinking water, latrines, urinals, and first-aid facilities for contract labor.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">If the contractor fails to provide these facilities, the principal employer is liable to provide them and can recover the expenses from the contractor.<\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"ng-star-inserted\" style=\"text-align: justify;\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Responsibility for Payment of Wages (Section 21):<\/span><\/strong><\/p>\n<ul class=\"ng-star-inserted\" style=\"text-align: justify;\">\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Contractors are responsible for paying wages to contract labor before the expiry of the prescribed period.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">The principal employer must have a representative present during wage disbursement.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">If the contractor fails to pay wages, the principal employer is liable to pay and can recover the amount from the contractor.<\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"ng-star-inserted\" style=\"text-align: justify;\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Penalties and Procedure (Sections 22, 23, 24, 25, 26, and 27):<\/span><\/strong><\/p>\n<ul class=\"ng-star-inserted\" style=\"text-align: justify;\">\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Obstruction of inspectors, contravention of provisions, and other offenses are punishable with imprisonment or fine.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Offenses by companies can lead to the prosecution of those in charge.<\/span><\/p>\n<\/li>\n<li class=\"ng-star-inserted\">\n<p class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Complaints must be filed within a specific timeframe, and courts can only take cognizance with proper authorization.<\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"ng-star-inserted\" style=\"text-align: justify;\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Miscellaneous Provisions (Sections 28, 29, 30, 31, 32, 33, 34, and 35):<\/span><\/strong><\/p>\n<ul class=\"ng-star-inserted\" style=\"text-align: justify;\">\n<li
